Traditionally, martial law has never been regarded as a good thing; it has invariably been considered, at the best, but a lamentable necessity. Whenever it had been applied and it followed close upon the heels of Anglo-American law throughout the world - it has, in instances too many to mention, occasioned abuse on the part of the military. For its purpose is to uphold the supremacy of law and order and/or preserve the life and existence of the state. The author aims to make a contribution to the legal literature of the country through a study of military law. The thesis is presented in the conventional manner and the views expressed in this work are in the writer’s own and do not reflect the opinion of the Judge Advocate General’s Office, nor of the Armed Forces of the Philippines, nor the Department of the National Defense.
