Declaration of nullity, annulment of marriage and legal separation under the family code of the Philippines and the implications of the supreme court decisions (1995-2000)
This thesis analyses the concept of marriage and the different legal remedies under the Family Code of the Philippines in case of its dissolution. The petitions for Declaration of Nullity, Annulment of Marriage and Legal Separation give spouses the option to seek legal recourse before competent judicial tribunals in the face of defective marital union. Scrutiny as to the different grounds of these petitions, the prescriptive period, the effect on the status of children as well as the capacity of the spouses to remarry, are taken into serious consideration in analyzing this significant topic. It concludes with the discussion of various Supreme Court decisions on the matter, covering the period of 1995-2000, as well as the nature of cases filed and disposed of by the Family Courts in the City of Manila.
